AT&T & Verizon/MCI got caught. How many others have not?

The Electronic Frontier Foundation (EFF) filed a class-action lawsuit on behalf of AT&T’s customers against AT&T on January 31, 2006. The suit accuses the telecom giant of violating the law and the privacy of its customers by collaborating with the National Security Agency (NSA) in its massive, illegal program to wiretap and data-mine Americans’ communications. Fourth Amendment to the U.S. Constitution.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

First I point out that the President, Vice President and every member of Congress, placed their hand on a Bible and swore under oath of office to defend and uphold this constitution. There are no "options clauses" allowing any of these people to choose what law to obey. ( also see "Signing Statements" )

In a nutshell what this says, and what the courts have upheld is that the government, in order to search anyone on US Soil, they must obtain a search warrant, based on probable cause demonstrating that there is a strong likely hood that evidence of a particular crime will be discovered. They must describe to a judge what it is they expect to find, and where they plan on looking. Courts have even held that to look inside something that is too small to contain that which is sought, even with a warrant in hand, constitutes an illegal search.

At the least there must be a showing of probable cause. In cases where a fresh pursuit of an escaping person leads them to a locked dwelling, officers do not have to obtain a warrant to enter to apprehend that person.

In the case of wire tap laws, the government is legally bound to the same rules as with any other search warrant. They are searching records or recordings for evidence. They must successfully convince a judge that they have probable cause to believe a crime is being committed, who may be involved and what records they intend to search...and for how long.

AT&T, Verizon and probably others are accused in collusion with the Feds in illegally obtaining with the intent to search for evidence of unknown crimes possibly committed by unknown persons, the private communications of US Citizens, without a warrant. This is a direct violation of the US Constitution.

It is a violation of their oath of office. It is a violation of the law, both civilly and criminally and Bush and Cheney and any official knowingly involved should be impeached, prosecuted and jailed.

The excuse that they "...were just following orders." did not work in the Nurenburg Trials for war crimes. It cannot be allowed now.

Now Bush want's Congress to pass a law granting immunity for anyone caught illegally spying on American Citizens.  Where is OUR protection from NSA and Bush as citizens?

I am also sending a letter to AT&T specifically asking if they have stopped providing my cell phone or internet data to the Feds. If they even bother to acknowledge my letter I will post their response here.
